Dear Attorney General Walker,
This will confirm receipt of Mr. XXXXXXX's complaint regarding the Bellini Italian Restaurant ("Bellini") in the 2011 Madison
Entertainment® Book. Mr. XXXXXXXX has stated that Bellini did not honor the published offer on Valentine's Day because it was a holiday even though the offer said "valid anytime".
Entertainment is a leading publisher of discount advertising promotions and we make it very clear that published offers-are subject to the rules of use and are not valid on defined holidays. The offer states that it is "Valid anytime, specials excluded, not valid with any other discounts and reservations are recommended". These are the merchant's terms and conditions of this offer. Continuing, the bottom of the offer further states "For Rules of Use go to www.entertainment.com/rulesofuse or see back of book. Valid at all participating locations. Not valid with other discounts, promotions or on defined holidays. Excludes tax, tip, alcohol and some sale items."
Review of the Rules of Use as stated in the back of the book or online rule 5 specifically addresses why the merchant may not have honored the coupon offer on February 14, 2011. Rule 5 states: "Valid Dates/Times/Holidays... Read offer carefully for valid dates and times. Major holidays, including those defined below, and regional holidays observed by participating merchants, are excluded, even if the offer states "valid anytime":
New Year's Eve/Day Mother's Day Valentine's Day Father's Day,
St. Patrick's Day Thanksgiving Easter Christmas Eve/Day
Accordingly, we do not believe we are in violation of Wis. Admin. Code ch. ATCP 131 and Wis St. ch. 100 as the offer and the rules clearly state that the offer is not valid on defined holidays. Additionally, because we have not received a copy of the receipt of the transaction with Bellini we cannot confirm whether or not a special was purchased which also would have invalidated the offer, pursuant to the disclaimers on the coupon. Finally, Mr. XXXXXX did not purchase his Entertainment® book directly from www.entertainment.com but rather it was purchased via an affiliate link. He would need to look to that affiliate for a refund.
